EMAIL AND TEXT MESSAGING

���Ĵ�ý offers the opportunity for website visitors to subscribe to an email campaign (~2-4 messages per month). Visitors who chose to supply an email address agree to periodic email messages from ���Ĵ�ý related to our programs, the application process, scholarships, deadlines and unique offerings. Subscription to the email notifications is not required to participate in ���Ĵ�ý programs and activities. Users may, at any time, unsubscribe from the email campaign.

���Ĵ�ý offers a subscription text message program under the name of “���Ĵ�ý Notifications and Alerts.”  You will receive recurring messages and message frequency varies.  Subscription to the program is not required for admission to ���Ĵ�ý programs.

You can join and opt in to receive ���Ĵ�ý Notifications and Alerts by texting JOIN to 49582.  After you provide us with your mobile phone number, you will have an opportunity to confirm or decline the service via a reply to an initial text message you receive from ���Ĵ�ý. By replying YES, you are completing your registration and agreeing that ���Ĵ�ý may send you recurring text messages (including SMS and MMS) to that phone number. T-Mobile is not liable for delayed or undelivered messages. Message and data rates apply.

Once registered, you may discontinue or opt out of our ���Ĵ�ý Notifications and Alerts by texting STOP to 49582.  Message and data rates apply.  By enrolling in ���Ĵ�ý Notifications and Alerts, you consent that following such a request to discontinue or opt out, you will receive one (1) final message from ���Ĵ�ý confirming that you have been inactivated in our system. Following such confirmation message, no additional text messages will be sent unless you re-activate your subscription.

LIMITATION OF LIABILITY

���Ĵ�ý shall not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, this site or the materials on this site, even if ���Ĵ�ý has been advised of the possibility of such damages. Applicable law may not all the limitation of exclusion or liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ���Ĵ�ý, its officers, directors, employees, agents, licensors and suppliers from and against all losses, liabilities, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions, any content you post to or make available on the site, or any activity (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

TECHNICAL INFORMATION

Access to the site is monitored. The requesting URLs, the machine originating the request and the time of the request are logged for access statistics and security purposes. Use of the site constitutes consent to such monitoring. The site may be unavailable from time to time due to mechanical, telecommunication, software, hardware and third-party vendor failures. ���Ĵ�ý cannot predict or control when such downtime may occur and cannot control the duration of such downtime.

MODIFICATIONS TO TERMS AND CONDITIONS

���Ĵ�ý reserves the right, at its sole and absolute discretion, to make changes in these Terms and Conditions at any time without notice. Your continued use of the site after any such changes signifies your acceptance of the Terms and Conditions as revised.

GOVERNING LAW AND JURISDICTION

Your use of the site shall be governed by the laws of the state of Indiana, without regard to choice of law provisions. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to the site shall be in the state or federal courts located in Indianapolis, Marion County, Indiana.
